Article 1: Fields of application and modification of these General Conditions of Sale


These general terms and conditions of sale apply without reservation to any order placed on the www.cardiodepot.eu website, even in the event of a contrary indication mentioned in our customers' general terms and conditions.
Cardio Depot reserves the right to adapt or modify these general terms and conditions of sale at any time. In case of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.

Article 2: Product availability

Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks.
Upon receipt of your order, we check the availability of the ordered product(s).
In the event of unavailability, we commit ourselves within 40 days from the validation of the order either to deliver the ordered product to you, or to refund it to you by check.

The date of validation of the order corresponds to:
- The date of the order in case of payment by credit card online
- The date of receipt of the cheque or transfer in the case of payment by transfer.

Packing / sampling:
As part of promotional operations on behalf of our partners, you may receive promotional messages in your parcels free of charge. Only one sample per person and per order is distributed. No complaint will be taken into account by our Customer Service on this subject.

Article 3: Validation of orders and electronic signature (law of 13 March 2000 on electronic signature)

Any order form signed by the consumer by "double click" constitutes an irrevocable acceptance which can only be challenged within the limits provided for in these general conditions of sale.
The "double click" associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

Article 4: Prices

Cardio Depot reserves the right to modify its prices at any time but undertakes to apply the rates in force which will have been indicated at the time of the Customer's order.
Prices are indicated in Euro all taxes included, excluding shipping costs. All orders are payable exclusively in Euro. If the order comes from a country outside the EEC, the Customer is the importer.
In this case, customs duties, local taxes, import duties or state taxes may be payable. These duties and taxes will be exclusively the responsibility of the Client without Cardio Depot being held liable in this respect.

Article 5: Orders

No order will be validated if one of the fields''mandatory information'', of the order form is not completed by the Customer.
Terms of Payment:
The possible payment methods are:
- by credit card:
Payment is made on our partner's secure banking servers (BNP Paribas). This means that no banking information about you is transmitted via the website www.cardiodepot.eu. Payment by credit card is therefore perfectly secure; the order will be recorded and validated as soon as the payment is accepted by the bank. If the transaction is not validated by the bank, for any reason, technical or banking, the order is automatically cancelled.
- by bank transfer:
The order is then recorded and stored for at least 7 days. After this period, without receipt of the  transfer, it may be cancelled. The order will only be processed upon receipt of the cheque or transfer.
Special cases of administrations:
For administrations that cannot pay with the order, Cardio Depot sends the orders from the administrations before having received the payment, accompanied by an RIB and the invoice. However, it is necessary for the administration to send a dated and signed purchase order.
Retention of ownership clause: the products remain the full property of Cardio Depot until the order has been fully collected by Cardio Depot. However, as from the receipt of the order by the Customer, the risks of the goods delivered are transferred to the Customer.

Article 6: Delivery terms and delivery times in Europe

6.1 - Terms and conditions
General information :
The products are delivered to the delivery address indicated by the Customer during the ordering process. The delivery of the package is made to the address indicated by the Customer at the time of ordering. In the absence of the Customer at the time of delivery, a notice of availability of the package is placed in his Letter box. In the event of an order for several products, Cardio Depot reserves the right to split deliveries. However, the Customer shall only bear the costs of a single shipment.

Europe :
Delivery by Colissimo (La Poste). 

6.2 - Shipping times
All announced deadlines are calculated in working days.
The times indicated are average times and correspond to the processing, preparation and dispatch times of your order. They incur upon validation of the order. To this deadline, we must add the delivery time of the carrier.
All orders for items available in stock are shipped within 3 to 4 business days (depending on the time of order).
6.3 - Delivery times
The ordered product is delivered by our carrier, to the address indicated by the Customer when ordering. The announced deadlines are indicated from our warehouses.
If the customer has indicated a valid e-mail address, he will be informed in real time of the shipment of his order and will be able to track his delivery tratement via the tracking number sent automatically.

Delay in delivery:
As delivery is made by a third party service provider, Cardio Depot cannot make a firm commitment to the delivery time. When a delay in delivery is noted (i.e. when the time spent since the departure of the package in working days has exceeded the delivery time assumed in working days mentioned above), the Customer may inform Cardio Depot. At the Client's request, Cardio Depot will then ask the service provider to open an "investigation", then wait for the service provider's response to this investigation to take action on the client's complaint. Although the observed response time of the service provider is generally a few days, it is important to note that the service provider's commitment regarding their response time to surveys is two weeks.
Under no circumstances may Cardio Depot compensate for late delivery of a package.

Delivery:
Cardio Depot asks its customers to check the conformity of the goods delivered at the time of delivery and before signing the carrier's delivery note.

The Customer must indicate on the delivery note and in the form of handwritten reservations accompanied by his signature any anomaly concerning the delivery (damaged product). This verification is considered to have been carried out as soon as the recipient, or a person authorized by the buyer, has signed the delivery note.

The Customer must also report any anomalies by registered mail and confirm his reservations to the carrier no later than 3 working days following receipt of the item(s) and send a copy of this letter to :

If the products need to be returned to us, they must be the subject of a return request to our Customer Service:

- within 7 days of delivery for a withdrawal
- within 15 days for defects or if you have not received the correct reference
- after demonstration of the customer and verification of the hidden defect


Any complaint made after this deadline will not be accepted. For a retraction or if you have not received the correct reference, the return of the product can only be accepted for products in their original state (packaging, accessories, instructions).

If at the time of delivery, the original packaging is damaged, torn, opened, you must then check the condition of the items. If they have been damaged, you must refuse the package and note a reserve on the delivery note (package refused because it is open or damaged).

Article 7: Responsibilities

Cardio Depot cannot be held responsible for the non-performance of the contract concluded, due to the occurrence of an event of force majeure and in particular in the event of a total or partial strike by the postal services, carriers, and disasters caused by floods or fires. With respect to products purchased to meet professional needs, Cardio Depot will not be liable for any indirect damages resulting from this contract, business interruption, loss of profit, damage or expenses, which may occur.
The choice and purchase of a product or service is the sole responsibility of the Customer.

The total or partial impossibility of using the products in particular due to incompatibility of the material cannot give rise to any compensation, reimbursement or questioning of the responsibility of Cardio Depot, except in the case of a proven hidden defect, of non-conformity, defectiveness or exercise of the right of withdrawal envisaged under article 8.

 

In the event of non-delivery of an order or part of an order, the Customer has a maximum of two weeks (from the date of departure from our warehouses) to notify us. Beyond this period, we will not accept any claims.

Article 8: Right of withdrawal

In accordance with Article L. 121-20 et seq. of the Consumer Code, the consumer has 14 working days from the date of delivery of his order to return any item that does not suit him and request an exchange or refund without penalty, except for the return shipping costs.

The product must be returned in perfect condition, in its original undamaged packaging. It must be accompanied by all its accessories if necessary. Otherwise, the Customer will lose his right of withdrawal and the product will be returned to him at his own expense.

Return costs for retraction:
The return costs in the event of retraction remain the responsibility of the Customer. In order to ensure the follow-up of your parcel, it is recommended to make this return in Colissimo "Expert" (parcel followed with signature upon receipt).

Method of reimbursement:
After receipt and acceptance of the return, Cardio Depot will refund by cheque.
In order to process the request correctly, the customer is requested to attach a copy of the invoice.

Article 9: Parcel processing: NPAI / unclaimed / refused

If the Customer's package is returned to Cardio Depot by the carrier or its partners for the following reason:
Does not live at the indicated address
or
Packages not claimed during the period of proceedings

Cardio Depot will contact the customer upon receipt of the returned package to ask him/her to follow up on the package. The customer can then:
- request the return of the package: the Customer must then pay the delivery costs for the new shipment in advance. This applies even to orders for which shipping costs are free: shipping costs are only offered once per order.
- request a refund of his order. Cardio Depot will then refund the Customer the total amount of his undelivered order by deducting 10 euros to cover the cost of sending the initial package and checking the returned remote controls. Cardio Depot will then proceed to a refund.
If the Customer's package is returned by the carrier for the following reason:  "package refused by the recipient upon delivery", then Cardio Depot contacts the Customer upon receipt of the returned package to ask him for the follow-up to be given to the package.
- If the package has been rightly refused, because it was not in conformity with the order (damaged package, product not corresponding to the order), Cardio Depot will return a new suitable package.
- If the package has been refused by mistake, the Customer may request the return of the package: he must then pay in advance the payment of delivery costs for the new shipment by colissimo. This applies even to orders for which shipping costs are free: shipping costs are only offered once per order.

Article 10: Guarantee

The equipment sold by Cardio Depot benefits from the guarantees provided by the suppliers.
Batteries are not guaranteed.

The effect of our warranty is strictly limited to the replacement of parts with a clearly established manufacturing defect. Items that have been subjected to abnormal use (falling, shocks, abnormal stress, etc.) cannot be replaced under the warranty.
The departure date of the guarantee is the date of delivery or availability.
The products sold are guaranteed against any defect or defect in material or workmanship, excluding:
- the replacement of consumables (batteries)
- abnormal or improper use of the products (please consult the instructions for use provided with the products carefully)
- defects and their consequences due to the intervention of a repairer not approved by the manufacturer, defects and their consequences related to use not in accordance with the use for which the product is intended (professional, collective use...)
- defects and their consequences related to any external cause, in particular related to the exposure of the products to water, heat or sun, the consequences of use not in accordance with the laws and regulations of the products.

Cardio Depot declines all responsibility in the event that the delivered item does not comply with the legislation of the country of delivery.

Article 11: Return under warranty

The return of the equipment is accepted by Cardio Depot under the following conditions:
The Customer must request by e-mail a return authorization from Cardio Depot at the following address contact@cardiodepot.fr
Without a reply from Cardio Depot within 2 working days, the Customer returns the merchandise in perfect condition, with its accessories if necessary, and in its original packaging.
All returns must be accompanied by a copy of the original purchase invoice.
Only postage paid returns are accepted.
To each allegedly defective material must be attached the precise and detailed reasons for the return.
The warranty is limited to the choice of Cardio Depot
- either the replacement of the equipment found to be defective
- either to repair the equipment found defective by Cardio Depot

Article 12: Personal information

In accordance with the French Data Protection Act of 6 January 1978, the Client has the right to access, rectify and oppose any personal data concerning him/her. For this purpose, the Customer must contact the Cardio Depot directly by writing to it at the following address:

Article 13: Dispute:

This contract is subject to French law, both for the substantive rules and for the rules of form. In the event of a dispute and in the absence of an amicable agreement between the parties, the courts within the jurisdiction of Cardio Depot's registered office shall have express jurisdiction.
